THIS IS WHAT IVE BEEN THINKING THESE DAYS. It's such a luck game. Also when they test racehorse type questions it's all about who can type the fastest and less about knowing the rules and how to analyze them.Animal_Activist wrote:Screw this exam. I’m inclined to agree with you. Some essays seem alright and then you get hit with something they have never tested or test rarely and it just makes you realize they really will test anything they want. On that note does anyone have any thoughts on random sub topics they might test? My biggest fear is contracts because there’s just so much and those are really hard for me to finish on time or at all. I could also see them doing a supremacy clause essay just to be mean.

Also, bear in mind that essays are scaled. So if you do get a racehorse exam that's close to impossible to finish in time, that's taken into account. When I took the bar there was an Evidence question that nobody I talked to came close to finishing in time. I had like three pieces of evidence to still analyze, and I moved on after my hour was up. Still passed.
To be fair, racehorse exams benefit the people who know the rules well enough that the can type them quickly without having to give them much thought. They tend to hurt the people who have to sit there making stuff up, since it takes significantly longer to create a rule that sounds right out of thin air. You don't win a racehorse exam by simply typing a bunch of nonsense quickly. You have to know what to type. If anything, they really differentiate between the people who have the law down pat, and the people who don't.wildmadagascar wrote:It's such a luck game. Why in the world are you doing that? Unless something has drastically changed, the bar only really tests 15b fraud, insider trading, and short swing sales. Those are the only regs you probably need to know, and they can be learned by reading a few pages in your commercial outline. Just learn that stuff and move onto the other corporate stuff. I highly doubt the bar will go all in on random SEC regulations. If they do, it would be in a PT where they give you the law. The week before the exam i had the same dream every night. Basically, id wake up 10 minutes before the exam and then there would be insane traffic on the 20 minute drive to th convention center and I'd end up showing up an hour late and they wouldn't let me in and I'd be crying my eyes out. I slept with the lights on from Monday until the exam was over.

Is it easy to pull over a car and being dropped off by the convention center or do they block the street around the center...? Any advice please? I am also considering driving myself too, but wonder how parking situation would be for those days... Thanks!

Guys, for grading, if I score a 119/175 on the MBE (I.e. 144) does that mean I pass the whole exam without the essays? Or I need to have a score of 144 on the MBE and essays? Or is the 144 split between the two? Can someone please explain?

That absolutely does not mean that. 119/175 is only roughly 68% of the questions answered correctly. That's about the lowest score you can get on the MBE to be on track to pass the exam. There's no such thing as "auto-pass", but the MBE and essays do work as a sliding scale. If you do REALLY well on the MBE, you won't have to do as well on the essays. Or, if you do really well on the essays, you won't have to do as well on the MBE. But even if you get a ridiculously high MBE score (like let's say 90%), if you got 0s on all your essays you would still fail. If you got 40s on all your essays, you'd still fail. But, you could royally screw several essays up and marginally pass the others and still be fine. Get it? So there's really no "auto pass". And 68% MBE score is not even close to being able to kick back on essays.

Naw taking Themis - many questions repeated - or same style same rule tested - so they up there - overall themis im at like 68% and overall adaptibar at 75% because i do those later.LawIsLife wrote:

I have a question regarding remedies.
I see everywhere that Rescission requires: (1) grounds for rescission and (2) no valid defenses, and Reformation requires: (1) a valid contract, (2) grounds for reformation, and (3) no valid defenses. Barbri even tells us Good Dog and Very Good Dog to remember the differences.
My questions is: Why does every essay answer go through a valid contract analysis for rescission if it doesn't seem to require it? I get that you wouldn't be trying to rescind a contract if it didn't exist, but I don't understand why they emphasize Valid contract for reformation and not for Rescission.
FWIW I'm doing (Barbri, Baressays, and have magicsheets). I felt like the lecturer in barbri was confusing and I seem to struggle with this topic as a whole.

The examiners want to see that you know the elements to a valid contract, and probably want to see that you know the other defenses, remedies, and excuses that are available. I took the exam in Ontario. It was hot but IIRC they kept it glaciar cold inside. I'm pretty sure I wore the jacket of my velour tracksuit. There is a del taco or taco Bell up vineyard, but youd have to pay to repark and it's not walking distance. There is a grocery store up vineyard...maybe two.....if you want to pick up something before the test.

The Weather Channel is forecasting 90 on Tuesday and 88 on Wednesday—not that bad. Carry a lunch or have one back in your room...you do not want to be stressed about lunch. I took a catnap during lunch. You can wear an analog watch, and on essay day, you can use the timer in Examplify, which I found helpful because it warned when the hour for the essay was up. My experience last July at Ontario was positive—the exam was well run, the proctors were cordial, albeit strict, the attending staff were encouraging, the tables and chairs were fine (although if I had to do it again I would have brought a seat cushion to raise me up a bit), and the other examinees were pleasant. You have worked hard to earn the right to sit for the exam—enjoy it!

Do the top essays that are chosen as model answers get an email that they will be the model answers?
