I recently accepted a state trial level clerkship contingent on a background check performed by a company that does that sort of thing. On my record, I have an eight-year-old drug paraphernalia ticket (petty offense/city ordinance) and a seven-year-old underage consumption citation. I don't even know if these will show up on the background check, but I'm wondering if I should disclose them to the judge anyway.

I filled out an authorization form for the background check, but all it required was a signature, my SSN, and my addresses for the past ten years. There was no "check this box if you have prior offenses" or anything like that, otherwise the answer to my question would be fairly obvious.

I'm inclined to let the judge know, but I don't know if that's the right move or not. My other option is to disclose the offenses to the human resources person who is handling my background check and the logistics of my hire.

Any thoughts?

Just have it appear on the background check. I don't see what notifying the judge will do that the background check won't.
